Sending unsolicited commercial email (trying to market to people who have NOT asked for their mails) is spam.  They have been banned from several LUG lists for this in the past.

Take a look at http://www.spamfree.org (the forum for resonsible and ethical email) for more on what is spam and what is not when someone tries to do 'direct email marketing'
