Of course, there should be a "unless against the national security interest"
clause or prohibited by legislation (export to Iran, Afghanistan, North
Korea etc in the US).

But when it is released to the public, it's illegal to discriminate against
a certain class of people according to American law.

GPL is a discriminatory license - it discriminates against those who write
closed source software for a living.
